THE COURSE IN NEGOTIATION AND MEDIATION

This is an intensive training in the most modern approaches to interest based negotiating as well as a complete mediation training. The two are offered in a single package, as to be a good mediator, one must be a skilled negotiator. Mediation training will improve the skills of any negotiator.

In this course, participants will learn the theory and attain the skills for effective conflict prevention and resolution. You will learn how to develop strategy and tactics for mediation and negotiation, how to perform as a neutral mediator/facilitator, and the ethics of mediation. Among the topics covered will be:

  • The causes of impasse and how to break through it.
  • How to distinguish interests from issues, and their importance in modern negotiations.
  • Important communication techniques such as active listening and neurolinguistic programming.
  • How to develop and present an offer in a manner that will reduce resistance and make your offers more acceptable.
  • How to receive offers so that you can modify them to better meet your goals.
  • How to manage a large, complex negotiation
  • Conflict analysis.
  • How to close.
  • The mediator's roles, and the components of mediation.
  • Mediation ethics.
  • Various approaches to negotiation.
  • How to plan your tactics and strategies, and how to anticipate those on the other side.
  • Reality testing.
  • Creating viable alternatives and options.
  • How to create and use agendas, as well as procedural agreements.
  • How to write an agreement.
  • How to develop long lasting agreements through developing solid relationships.
  • Psychological considerations.
  • Managing and resolving disputes as a neutral mediator/facilitator.

The next U.S. public offering of the course will be at a Summer Institute at California State University, Sacramento, June 16 - 20, 2007. Mr. Yamshon will be the lead trainer and cross-cultural negotiation & mediation will also be covered. Mr. Yamshon has presented variations of this course in Africa, Latin America, Russia and the United States. California State Bar continuing education credit will be offered, which is usually recognized by other State Bar associations and other professional licensing agencies. Many organizations utilize Mr. Yamshon's training for fundraising, and courses can be custom developed on request. Time formats can also be adapted for weekend presentations.
